Slip and fall Sidewalk Injury

This claim arose when the firm’s client tripped and fell due to a defective sidewalk and injured her knee, necessitating an operation. The case settled for the home-owner’s insurance policy limits of $100,000 for the owner responsible for the condition of the sidewalk. The case was handled by Martín Arias.

Polish man suffers brain injuries; internal bleeding; broken bones in car crash

August, 2009

A man was severely injured when the driver of the car in which he was a passenger slammed the car into a telephone pole while intoxicated. The car burst into flames. Fortunately emergency personnel were able to douse the flames before they engulfed the car. After being Life-Flighted by helicopter to a hospital, the firm’s client received extensive treatment for his injuries. Because he spoke only Polish, he could not communicate with hospital personnel without a translator.

When he was released from the hospital, the man came to Zajac & Arias to prosecute his case. Dominik Rostocki, Esq., who is fluent in Polish, bridged the communication gap and was able to discuss the details of the case with him in Polish. Zajac & Arias took the case and obtained a settlement to the full extent of the driver’s insurance.

Jury rules for client in medication overdose trial

June, 2009

A Philadelphia County jury has decided in favor of a firm client in a medication overdose case.

The firm’s client suffered from an overdose of Zyprexa. He had been administered the drug by the staff at a nursing center where he was a resident; the order for the anti-psychotic medication had been called into the facility by his treating physician three days earlier.

Just prior to trial the client settled with the nursing home for an undisclosed amount but it remained in the action as a defendant. The trial evidence showed that the client was given 10 times the proper amount of Zyprexa, causing the client to require an emergency room admission for Zyprexa toxicity.

The jury found that the nursing home was fully liable for the client’s damages and awarded Greenberg $125,000. While the jury found the doctor to be negligent, his negligence was not found to be a cause of the injuries.

Crane Collapses into Sinkhole; Two Construction Workers Seriously Injured

March, 2009

Zajac & Arias represented two employees of a construction site subcontractor. As employees of this company, they were assigned to report to work at construction projects at various locations. On the day of the incident, they were performing their regular and assigned job duties at a construction site near Mount Joy, Pennsylvania. For one of our clients, it was his first day on the job.

Due to the Defendants’ alleged negligence, a crane that was located at the construction site fell into a sinkhole. The collapse caused the boom of the crane to crash into the steel girders on which our clients were working at the time. Both clients were caused serious and permanent personal injuries.

The case settled during the litigation for confidential sums, following the depositions of our clients. The cases were handled by firm member Eric G. Zajac.
